DISPUTE RESOLUTION & ARBITRATION

In the event of any dispute between you and HairScripts by Bevy, you agree to first contact us directly at support@hairscriptsbybevy.com to attempt to resolve the matter informally. We will respond within 30 days.



If we cannot resolve the dispute informally, you agree that:

  • Any dispute, claim, or controversy arising out of or relating to these Terms, our products, or our services shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
  • Arbitration shall take place in New York, New York, unless otherwise mutually agreed
  • You waive your right to participate in any class action, class arbitration, or representative action against HairScripts by Bevy
  • Each party is responsible for its own legal fees, except where the arbitrator determines that one party should bear the costs


This arbitration clause does not prevent either party from seeking injunctive or equitable relief in court for matters relating to intellectual property, trade secrets, or breach of confidentiality.

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles. Any legal action or proceeding that cannot be resolved through arbitration shall be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the jurisdiction of those courts.

CHANGES TO TERMS

We reserve the right to update or modify these Terms at any time without prior notice. Updates will be posted on hairscriptsbybevy.com with the "Last Updated" date revised at the top. 

Your continued use of the website or purchase of our products after changes have been posted constitutes your acceptance of the updated Terms. We recommend reviewing these Terms periodically.

SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

ENTIRE AGREEMENT

These Terms, along with our Privacy Policy, Returns & Refunds Policy, Shipping & Delivery Policy, and Subscription Management Policy, constitute the entire agreement between you and HairScripts by Bevy regarding your use of our website and products, and supersede any prior agreements or understandings.
